Obamacare Faces Major Supreme Court Fight! Here’s What’s at Stake …

Mike Larson | Wednesday, March 4, 2015 at 4:30 pm

MARKET ROUNDUP
Dow -106.47 to 18,096.90
S&P 500 -9.25 to 2,098.53
Nasdaq -12.76 to 4,967.14
10-YR Yield +0.001 to 2.123%
Gold -$5.50 to $1,198.90
Crude Oil +$1.31 to $51.83

Obamacare is the source of passionate debate around the country. Now, it’s the focus of scrutiny in the hallowed halls of the Supreme Court!

The nation’s chief justices heard arguments today about whether the Affordable Care Act, as currently structured, is fundamentally flawed. At issue are federal tax subsidies that help individuals buy health insurance. The law says subsidies should be available to people who buy insurance in marketplaces “established by a State.”

But only one-third of U.S. states have formed exchanges. In the rest of the states, individuals buy coverage through federally run exchanges. Obamacare opponents claim in the King v. Burwell case that subsidies for those buyers are therefore illegal, as the marketplaces are not state-run.

The Supreme Court is hearing another challenge to Obamacare – the Affordable Care Act.

We likely won’t get a court decision until June. But today’s arguments will help determine whether justices will side with the Obama administration or the Obamacare opponents.

What’s at stake here? If the Obama administration loses, more than six million individuals would lose the tax subsidies they’ve used to buy insurance through the federally run Healthcare.gov website.

That, in turn, would make coverage unaffordable for a large portion of those buyers. A large portion of them would cancel. So would many healthy individuals. That’s because coverage would no longer be deemed affordable for many of them, exempting them from the financial penalties Obamacare mandates for people who can afford insurance, but choose not to buy it.

The end result? A “death spiral” for the health care law and the insurance programs central to it.

Naturally this is a huge issue for uninsured Americans, who face the loss of affordable coverage. It’s also a huge issue for hospital companies, drugmakers, insurers, and others who have benefitted from the increase in the insured patient population. So if you’re invested in the health care sector, or if you’ve had trouble affording insurance, I’d keep a close eye on today’s Supreme Court drama!

“Naturally this is a huge issue for uninsured Americans, who face the loss of affordable coverage.”

With this major challenge underway, I wanted to hear your opinion on Obamacare. Does this case have merit, and would you like to see the law derailed? Or is it just another attempt by disgruntled Obamacare fighters to stick it to the President with a questionable legal argument? Are you invested in health care stocks, and worried about the outcome here? Please share your thoughts at the Money and Markets website when you have a minute.

Our Readers Speak

Nasdaq 5,000 – just a stepping stone to higher prices? Or a last gasp before the big fall? Here’s what you had to say …

Reader Chuck B. said we could have further to run, given the fact we’re still nowhere near the inflation-adjusted peak for the tech index. His comments:

“Someone else ran Nasdaq 5,000 through the Minneapolis Fed’s inflation calculator. Turns out that would equal 6,960 in today’s dollars. There are many other reasons to think the markets have a ways to go before they peak out. PEs are nowhere near what they were in 2000, for example.”

Reader Mike P. discussed several reasons why today’s market environment is different than it was back in 2000, and offered his own forecast of the future:

“There are a number of differences between now and the ’90s.

“1. Retail investors seem to still be scarred by the 2008 crisis. In 1987, the stock market crash affected far fewer people than the 2008 crash, but even then, the stock market really didn’t take off until 1994, seven years later. We’re just at that point now relative to 2008.

“2. Demographics have changed, which may explain the demand for bonds as Boomers retire or their target date funds near their endpoint. Getting a coupon payout every month just seems more reliable than hoping for increasing returns in your stock portfolio.

“3. In the 90’s, the goal was to launch a website and sell out to insatiable investors. That’s not so easy now.

“4. Biotech seems far more bubbly now than back then. However, the promise is greater now with improving technology and extreme pricing.

“I’m expecting another October-like selloff when the Fed raises rates, but then another snapback as the bull market continues for a few more years, albeit at a tempered rate of increase.”

On the flip side, Reader Billy said all signs point to an end to this epic run: “No question from a macroeconomic, technical, cyclical, and demographic standpoint, we are in a classic topping scenario for the capital markets.”

Finally, Reader Kent G. thinks the market rally is built on a wobbly foundation:

“The entire market is a sham built on cheap financing, bogus earning reports and massive stock manipulations. Real companies earn their profits by sales, not stock manipulations and buy backs. No sales, no earnings, no new jobs. Not all that tough to figure out. Stir in a few trillion in vapor money and you get a vapor economy.”

You couldn’t ask for a more diametrically opposed set of views. We’ll have to see which side wins out in the end. And just in case you missed it, I’ve shared my personal take:

Investing in rock-solid companies, with high Weiss Ratings, in powerful sector bull markets is still a smart way to go. Energy stocks and foreign equities also look ridiculously beaten-down and cheap, cheap, cheap … offering opportunity to savvy investors. Should my “crash indicators” start flashing yellow, I’ll change tacks. But that’s not happening yet!

As always, this website link is where you can add your two cents to the mix.

Other Developments of the Day

BulletThe U.S. job market is the focus of attention this week, thanks to the release of fresh data. ADP said today that the economy created 212,000 jobs in February. That was down from an upwardly revised 250,000 in January, and the weakest rise in six months.

Keep a close eye on what happens tomorrow with the European Central Bank, and what the Labor Department says on Friday in the “official” jobs report. Those events could determine the next major move for the U.S. dollar.

BulletExxon Mobil Corp. (XOM, Weiss Ratings: C+) became the latest energy sector giant to react to lower oil prices by slashing capital spending. The company told analystsin a presentation today that its capex budget will sink to $34 billion in 2015 from $38.5 billion last year.

BulletIt’s gorgeous here in South Florida … again. Not so much in the rest of the country. Yet another winter storm is sweeping through the Midwest and Northeast, dropping copious amounts of rain, sleet, ice, and snow on millions of Americans who are probably ready to hang the Groundhog up by his paws!

BulletI enjoyed the movie “The Internship,” where Vince Vaughn and Owen Wilson land coveted starter jobs at Google (GOOGL, Weiss Ratings: B+). The campus (some scenes were filmed there; others were recreated in Georgia based on the real Mountain View headquarters) seemed like a great place to work, packed with perks and much less straight-laced than many corporate environments.

But according to the Wall Street Journal, you ain’t seen nothin’ yet! That’s because Google, Facebook (FB, Weiss Ratings: B-), Salesforce.com (CRM, Weiss Ratings: C-) and other growing tech firms are snapping up hundreds of thousands of square feet worth of real estate in Silicon Valley and San Francisco.

The goal? Secure land for flashy new offices and buildings full of high-end perks. The risk? These companies get stuck paying too much for real estate they won’t need later if growth doesn’t live up to expectations, just like it didn’t in the dot-com bust of the early 2000s.

Do you think this land-banking strategy makes sense? Are you sick of all the snow? Is Exxon making the right move by cutting its capex budget? The website is your outlet for discussing these stories, so be sure to take advantage of it!

Until next time,

Obamacare needs to be scrapped and replaced. Tort reform, buying across state lines, health savings accounts….people need to have some skin in the game! Insurance should be available to the uninsurable.

Joe Carter Wednesday, March 4, 2015 at 6:25 pm

Can’t agree more. However, Obama’s law writing and amending needs to be called what it is. I have little faith in the Supreme Court after seeing justice Kagan’s views today. Logic was missing in her comments. Don’t have any faith in the Supreme Court and worry what will happen if they support Obamacare. Pair that with Iran and everything else and we may face civil disorder and much worse. Pray!

The SCOTUS will “justify” it. The reason is that the SCOTUS is 6/9 hard core Catholic and how else to pay for the health insurance and making babies for the 60 million illegal alien Catholic invaders.
Treason is the name of the game.
See that a full third of every elected office in the USA are of the same “religion”.. Half are r and half are d and all are C.. this is not good for the USA. This bloc has now gotten 6/9 hard core “religious” on the SCOTUS, the very body that interprets the Constitution.
The C-d do not like guns The C-r do not like Roe v Wade. Neither like
the Constitution. If you do like the Constitution do not vote for the
‘religion’. If you like science, do not vote for the “religion”. All the illegal alien C invaders are of the “religion” Guess what it is!
If an elected person is now sworn in on the CONSTITUTION do not vote for them.

Hey Mike….Don’t forget the LEFT coast,we have had a gorgeous winter here also other than a little wind and too little rain.Went skiing the last few days…spring conditions, not a cloud in the sky and 70 by the end of this week..

John M Wednesday, March 4, 2015 at 4:54 pm

Health care and health insurance have always been separate. Insurance is inherently inflationary due to the loss of quality and cost transparency. College costs rose when student loans became guaranteed. Medication costs rose when medications became covered in health plans. Home prices skyrocketed when mortgages were broadly guaranteed. Whereas you probably know which local grocer has the best prices on favorite items, which has the best bakery, which has the best produce, and which has the best meat and seafood. If you want to make healthcare affordable, you add transparency to the market and trust consumers to make suitable choices about health care from a broad menu of health care (not health insurance) choices. You don’t create a corporate welfare program for insurance companies and mandate consumers participate. Insurance is the cause, not the solution.

Mike S. Wednesday, March 4, 2015 at 4:59 pm

You appear to not be aware of drug costs with GOVERNMENT Medicare and drug costs without… :( You appear also to be unaware that water, electricity, sewer, police and fire protection, to list a few, are products we all have to have to survive… Is Healthcare any different? Most of the civilized world has figured that out…

Ed M Wednesday, March 4, 2015 at 5:38 pm

Utilities are REGULATED public companies, NOT government-provided anything. Police, firemen, schools, etc. are LOCAL run by cities or states, and close enough to their constituents to be quickly responsive to them when necessary. Not so with our federal government, which is run by professional politicians, and both parties prefer to “govern” for their own re-election rather than do what is good for the future – or even the majority at the present for that matter. Want to look at federally run things? Try the post office (broke) Social Security (broke), Amtrak (broke & minimal service), Post Office (broke)!! Rightly referred, you disproved your own point.

Re: comment by Mike S.

I agree. It’s always the people who have healthcare, or are healthy thinking others don’t need coverage. My family has benefited enormously due to the fact a person can’t be denied due to previous health problems. We are not part of the crowd that needs subsidies, but Obamacare is a godsend to our family.

Jim Thursday, March 5, 2015 at 8:47 am

Of course it is a “godsend” when your neighbors are forced to pay your bills at the point of a gun. Wake up!

Beth Sunday, March 8, 2015 at 8:17 am

Thank goodness that someone else thinks this has been a Godsend to their family. I thought it was only our family that has been helped. It’s fine for others who can afford crazy expensive premiums for very little coverage, but for those of us who have gone backward financially for years because of out of control medical costs, the new healthcare laws have actually allowed us to not lose financial ground this year. For the first time in twenty years, we actually can tread water fiscally. I hear this kind of conservative talk all the time from people who gripe about the government and how they screw everything up, but these same hypocrites run to the medicare benefit the minute they get sick when they get old. If the system works for others around the world, why can’t people see it could beneficial here?

Howard Wednesday, March 4, 2015 at 7:19 pm

We need to get the government out of this where they guarantee benefits with tax payer dollars. The government is incompetent and inefficient and stifles free enterprise. Why would anyone want to start a business with the government telling you what to do and how to do it. Small business is hard enough already.

Chuck Burton Wednesday, March 4, 2015 at 7:50 pm

I wonder how many of those health insurance companies Obama has in his trust fund.

Excellent post John.

Fred1 Wednesday, March 4, 2015 at 4:54 pm

This law is all screwed up. The justices SHOULD rule on what it says and what was passed (NOT THE POLITICS) and tell congress and the president, if you want to fix it, go back and fix it. Otherwise, it says what it says and those states are out of the program. Period. Nancy Pelosi herself said that we should wait to read it until it was passed. Well they did that and now it has been found out that it is a screwed up piece of garbage.

So it must either be scrapped or go back to congress for repair. And those people that want someone else to pay their coverage….let them go on Medicaid. Millions already have under Obama just like he has added millions to the Food Stamp rolls. I would much rather have people on recognized WELFARE, FOOD STAMPS AND MEDICAID than a stealth program where some in the middle class get screwed and their neighbors get lucky due to government mandate. That is NOT the America of our history.

The Republican version of healthcare for the average American citizen: They (the 1%) have it and you (the 99%) don’t… :(

Jim Wednesday, March 4, 2015 at 7:21 pm

The Republicans gave done virtually nothing to interfere with Obamacare despite promises to the contrary and won’t. No one in Washington wants to be accused of taking a freebee away. My middle class family has had excellent and affordable healthcare for years before Obama. Since the bill passed my premiums doubled and my deductible went from $300 to $3000. AND I lost my cardiologist of 20 years. I’m sure the ACA has helped some people but it has also done a lot of damage. Jim

Having been born and raised Catholic I assure you none of this has ever occurred to me but I have to admit I always wondered why my church was so sympathetic to the alien invaders to the point that many clergy openly defy the law and harbour them and tell us we have a duty to take all of them in and care for them at whatever the cost because it is our religious duty. Your sweeping criticism is duly noted and I will consider it further. I will make a future informed reply. Jim

Maughan Thursday, March 5, 2015 at 7:17 pm

Yes, notice that this country was built by Protestant immigrants, and not a single Protestant on the Supreme Court. Not one; 6 Catholics and 3 Jews. How did this happen?

Monte Saturday, March 7, 2015 at 12:55 pm

Agree with you, Jim. I turned 65 in February and am now on Medicare. My personal health insurance has actually therefore reduced in cost. However, I pay individual premium for my wife and daughter. We now pay more than double in premium, with the same health insurance company as of Jan., 2015. Nothing has been done to control or alleviate the rising cost of health care or insurance, and I thought that was the debate before Obamacare was instituted! I only foresee a total collapse of the American healthcare system, regardless of the decision by the Supreme Court. In my case, my wife is also a citizen of the Philippines, and because there is no national health care there and few people there can afford health insurance most transactions are completed directly with the physician or hospital involved. Their costs are a fraction of ours. We have assisted relatives there with paying their bills for care. Most visits to a doctor’s office range from $ 3 to $10 (U.S. dollars). Our daughter has spent three days in a semi-private hospital room in the Philippines …. total cost $ 500 (U.S. dollars).

Howard Wednesday, March 4, 2015 at 7:25 pm

Or Mike, lets keep the politics out of this just for a moment. Some employers can’t employ because of this invasion of their business.

Liam Wednesday, March 4, 2015 at 4:58 pm

This is not a law. It was formed by illegal means and must be scrapped. It is unfortunate that ignorant people were sold a worthless product from a snake oil salesman and will lose coverage, but you get what you pay for. It’s funny that if a business perpetrated a fraud like this they would be strung up and imprisoned, but not our government. This is the banana republic people voted for so let them suffer the consequences of their ignorance. A storm is coming. Try to warn everyone who will listen to stock up on essentials. The ride is going to be a rough one and the nanny state will not be able to help you. A government powerful enough to give you everything you need is strong enough to take everything you have. The positive side is it isn’t to late too confess your sins and bring God into your life. Our once great nation thrived due to our Judeo-Christian values. Now we are staring into the abyss because God has been replaced by Gay marriage, abortion, and the religion of climate change

Obamacare is nothing more than an elaborate fraud to hobble and socialize health care. Its been followed by common core to socialize our educational system and now net neutrality to hijack the internet. Anything to take over what used to pass for free enterprise by a socialist regime and ever more bloated Govt.

Jim Wednesday, March 4, 2015 at 7:26 pm

It’s really simpler than that. It just puts the taxpayer on the hook for the bill!

Totally reject ObamaCare and start over.
Any plan supplied by the extreme leftists back Obama, and Pelosi bleating ‘You must pass it to read it’ definitely should be rejected.

Steven Wednesday, March 4, 2015 at 5:18 pm

With all due respect, the single-payer system known as O’Bama Care was fashioned by lobbyists for Big Pharma, Anthem, Aegis and other large-scale HMOs and special interest groups such as AARP. Obamacare is a federal overreach into the governance authority of the states, as was Medicare. Under Obamacare, doctors will be treated worse than many residential real estate appraisers, and many have left the profession as a result. The Federal debt Obamacare incurred and the regulatory burden it has imposed upon business portends to bring down the economy at the onset of another recession. The plan the GOP presented made much more sense but was discarded in one of the most egregious displays of retributive partisanship that this country has ever witnessed. I hope that the SCOTUS finds for the Plaintiffs so that America can return to the drawing board and design something better than this flawed excuse for health care.

Jim Wednesday, March 4, 2015 at 7:30 pm

Everyone in Washington likes the ACA including SCOTUS. They will NEVER invalidate it on their own. Just look at the illogical hoops Roberts jumped thru the first time. This whole thing is about total and complete contempt for the Taxpayer..

Virtually every President including Reagan has spoken out in favor of some kind of Univeral Health Insrance for all citizens. Operating costs of our current system are double that of other countries. If you knew the compensation of Privatized Health Insurance executives it would make you sick.

raymond long Wednesday, March 4, 2015 at 5:26 pm

the current cost of the subsidies is average 5000 dlrs per person (not family) ,this does not ssound like a cost efficient way to provide healthcare. the signup cost is 600 dlrs average..
but if we must have fed healthcare coverage then I would say just put everyone on medicare – cradle to grave -, in graduated stages by age starting with catastrophic coverage leading to final old age medicare . . individuals could still be free to buy private insurance and companies/unions still allowed to provide coverage as they choose. extended medicare would be paid for by a fed sales tax so that everyone contributes to its cost, not just the working class.

Who cares what Romney did.Obamacare is a disaster and should be repealed. We need incentives for better lifestyles. Not incentives to use more healthcare. As usual,Dems have it upside down.I take care of my self and haven’t had insurance since 1979.Not going to start paying $6K a year now. Will be getting Medicare in 1 1/2 years.May start needing insurance,as I age. That’s why they set Medicare at 65.No one figured everyone had to have insurance before then. This massive insurance system drives demand and prices soaring.

Steve Wednesday, March 4, 2015 at 5:32 pm

This law was passed with all kinds of unfair and under the table dealings. Like exempting certain unions and groups as well as congress. If it is so good why is congress not signing up? It does not pass the smell test as far as fairness goes. The Supreme Court should follow the letter of the law and rule that the bill is what the wording says it is in plain English. The Supreme court should be unanimous in their opinion and rule that Congress should READ bills before they vote on them so they know what is in them,. Nancy Pelosi is the one to blame as she said you have to pass it first to know what is in it. Well someone has finally read it and they found out what it really says. If the Congress took the time to debate each section and get everyone’s input the law would be clear on its intent and wording. But congress at the time wanted to rush it through before anyone knew what was in it. Intent on this particular section though happens to be very clear as they have video tapes of one of the key architects bragging of the bill, stating they wrote the section so as is to put pressure on the states to set up exchanges otherwise the people in their states can not get the subsidies. He also referred to the stupidity of the American People because if they were not so dumb this bill would have never been passed. So I do not know why there is any question as to intent on this section. Intent of the whole law was to put one over on the stupid American People. The writers of the bill told us this in there own words.

Howard Wednesday, March 4, 2015 at 7:42 pm

Steve

Two points.

1. Congress may have a better form of cover.
2. Would you let a director in your boardroom who says, ‘Just pass it first to know what’s in it.’ Business has to be competent and our politicians don’t

Ronn Langford Wednesday, March 4, 2015 at 5:39 pm

Your use of the words “questionable legal argument”, in my opinion, defines the situation extremely well. I believe that “most of us understand what was intended in the law as was written – it was even “explained” in terms of the Fed government NOT taking on the expense of what was intended to be State organized and operated subsidy programs (State Exchanges). The only problem is that 37 states made the decision that their state budgets could NOT afford to subsidize. That means that 13 states understood the process as the law intended, and created State Exchanges.

So now we can look at a “questionable legal argument”, and ask the question . . . How can a member of the Supreme Court actually have an opinion that is NOT based upon the “law” – and, in fact, choose to play games with their opinions and be “out of integrity”???? This would be like putting a square block into a round hole, and “making it fit” by justifying it on the basis of their interpretation – rather than a legal argument!!!

Medicare for those that can not afford any plan. With proof.

Socialized medicine does not work in Europe, and Canadians routinely come to the U.S. for many significant healthcare needs simply because they have months and months “wait time” for any appointment and another wait time before the actual procedures. ObamaCare is not (yet) socialized medicine, only the first step of govenrment control (and freebee care) toward that intended end. Liberty and freedom is better – get a job and earn your own way. Living on the public should be left to legitimate Social Security (they paid for their ‘retirement’) and the disabled. More than that is fraud and leads us to where we are – disorder, confusion, and declining care with fear of loss. Free stuff is NEVER FREE.

books Wednesday, March 4, 2015 at 6:29 pm

Ed M – If you want the freedom to die of illness w/o insurance, be my guest. I for one appreciate the concept of insurance for all. I know a number of Canadians personally who appreciate their coverage in Canada. Some Canadians come here for some healthcare procedures, but there are Americans going to other countries for procedure they can’t afford here.

There were 30 million people uninsured, N ow how many are uninsured? There are supposed to be 10 million that have been signed up for the ACA. How many of these people where already on Medicaid? The ACA is an attempt at health insurance reform that was very Republican , it brought in the insurance industry and for profit care providers and they squelshed a real single payer system like Medicare that costs way less in overhead % than any of the private insurers. Health care should be a regulated utility, it is needed in a developed economy, and as a community we are more productive if we have healthier people .
Real health reform means actually getting rid of a system where we pay when sick and figuring out how health care dollars can be spent to reduce illness and incentivize healthy living. The only “socialized” targets should be the children and elderly who tend not to have the resources or knowledge to invest in healthy behaviors,
The ACA should be progressively amended not demonized. The intent was to decrease the embarrassing situation of poor health outcomes and excessive health care spending that left large numbers of people out of the health care loop

Words still have meaning and we are still a nation which should respect those laws for the common good. The politically charged Obamacare scenario is one where the President wants it both ways, his way as he intends from time to time, and without interference with from the unfortunate writing of the law so Nancy Pelosi could find out what was in it.

If the Supreme Court finds in a 5-4 vote (no doubt) that the words do not mean what was written as with the tax/penalty issue, they will have ceded their independence and integrity in favor of the ill-written legislation. Americans will then no longer live in a nation under a counterbalanced government. May as well trash the constitution as Obama has tried to do.

Anybody with any intelligence knew that Obamacare was a debacle from the beginning. It’s already raised prices for healthcare and insurance. This is only a step for full socialized medicine, which will also be a bust. See Ed M. comments. Americans will not and should not have to wait to get heart surgery or a breast biopsy. This is what will happen with socialized medicine along with high taxes to pay for it. Do you trust your government to run healthcare. I sure don’t.

I get the feeling that the ACA was passed without a whole lot of thought. If the government’s goal was a single payer system, why not expand Medicare? while not perfect, more people are happy with the system than not. This should not be in America. The ACA law says what it says ! The subsidy applies in those states that chose to set up exchanges. My 2 cents is that the SC will come down on the side of Obama regardless what the wording of the law says. And THAT is what I mean by my first sentence. Our elected (and appointed) leaders have come to this. The wording of law means nothing to them — unless that wording fits their agenda. What recourse do we as citizens have? We get to vote for people offered to us by the two main parties, and that’s about it. Too often, we don’t want either one.

The uninsured will vote their state politicians out of office and get copy another state exchange (CT is decent) for themselves. In the meantime the cost of all healthcare will go up in those states without the exchange giving the states with an exchange a competitive business edge because all insurance rates are based on the cost of doing business in that state. The real coup d’etat will be if the president cuts the DSH payments to hospitals because now in theory no one is uninsured and it is no longer needed. State without HITE then will see health insurance for everyone in their state go up but not in the 16 states with their own exchange.

Let me get this straight. This massive new tax labeled Obamacare is so nourishing it had to be label as a healthcare program that would open the door to paradise and save me hundreds of dollars. It has stirred emotions to a pitch not seen since the Civil War in this country. It was sold with lie after lie after lie (need I continue repeating). It had to be forced down my throat without so much as one single debate among adults as to its merits. If Romneycare is the prototype for Obamacare I am just as opposed. Therefore don’t deflect the issue and call me a racist because I know what is better for me than forces in charge. Have you noticed that we all want to do what is best for the masses, yet some of us want to reach compromises while others of us are not happy unless they can force their views by any means necessary. Never has the phrase “Follow the money” been appropriate to the extent as it is today. It was passed and we SURE DID find out what was in it. I’m not sure Democrats or Republicans can save this Great Nation. God, PLEASE, bless America.

I guess I’m too much like Ms. Pelosi who “hadn’t read the thing to know what was in it.” Of course anyone with compassion is in favor of decent medical care for people who can’t afford high premiums, but the administration was in too much of a hurry to implement their plans, and the result is chaos. Anyone with relatively good health should be thankful that they’re not having to test Obamacare.

I’ve read over 2/3 of the Affordable Care Act. It’s on the internet. If you read an hour a day or more you’ll get through it. That way you know for yourself what is intended in the law.

Michael Clancy Wednesday, March 4, 2015 at 6:22 pm

Mike,

First sentence next to last paragraph “affordable insurance”. I’m hoping that that was a stream of conscientiousness error.

Clint Wednesday, March 4, 2015 at 6:25 pm

Scrap it, it was never intended to cover all. Only illegals and those who don’t wanna work cause they get most other things free anyway. It’s all about perception, Just look at the recent DHS funding fiasco and the jellyfish spined congress and immigration reform. Reform my foot. So long as the occupant of the WH is in the game, nobody wins. Real balanced reform will come when the three branches of gov’t actually work, not showboat.

books Wednesday, March 4, 2015 at 6:40 pm

Clint, if you read the first 14 pages of the law you would know that illegals cannot get on Obamacare. Computers coordinate the Immigration Dept, Homeland Security, and Social Security to be sure. It is stated REPEATEDLY that illegals can’t get coverage.

Jim Wednesday, March 4, 2015 at 11:26 pm

Obama simply declares them legal by executive order and then they get it.

Glenn M. Wednesday, March 4, 2015 at 6:29 pm

Obamacare needs to be repealed and I hope the Supreme Court rules that the subsidies are illegal under the law. There are many simple solutions to providing health care for the majority of Americans. Increasing the medicare tax on pay role or even just writing a check to individuals would have been a better solution. Instead, they destroyed the whole healthcare system in this country.

We force people to get car insurance, whether they want to or not, to get a driver’s license. The so called rebuttal is tha health insurance is only for you, but a car could hurt other people. Ebola fever, tubercolosis, flu, hepatitis a, pneumonia and multiple other infectious diseases can be spread without direct contact,. your life and other people’s life are more dependeny on health insurance than car insurance. In addition, we end up paying more when people with no insurance end up in the er, then the hospital, and sometimes rehab, and/or long termcare. We are left paying the bill, which would be more than ig they had insurance.

richard platt Wednesday, March 4, 2015 at 6:36 pm

We have the highest cost system in the world and only mediocre health results. Scrap Obama Care and lets get a single payer, medicade for all, Canadian or British style system where medical care is FREE to everyone. The experts agree but special interests prevent it from even being discussed!

Get the frigin federal govt out of health care. I am sick and tired of more and more fed govt in my life. Big govt has never worked and we sure could use a lot less of it in the USA

books Wednesday, March 4, 2015 at 10:57 pm

Joan, I want my meat tested, vaccines, research, help in time of disaster, Social Security, Medicare, Medicaid, the Interstate highways, the protection that our armed services give us, oversight of the banks that gave us the 2008 Meltdown, consumer protection (thank you Elizabeth Warren), laws preventing child labor, food stamps, public health. There are so many things we take for granted that make our lives safer, much of which was a result of government. I really don’t want to see people starving and dropping in the streets or going uneducated like a third world nation.

This mindset of each man out for himself and no thought for the common good is a recipe for disaster.

The government is “in your healthcare” only if you get Medicaid or Medicare. Other wise the insurance companies are “in your healthcare”. If you should become poor, then you might appreciate government subsidies to cover you in illness (think big stuff like cancer or heart surgery).

Also, Republicans pushed for the insurance companies rather than a single payer system. In the ACA act there was a fear that insurance companies would soak their policy holders with enormous deductibles, so it was written that there would be caps of around $6K for individuals and up to $10K for families. The insurance companies promptly raised their deductibles to the max. I hate to see what would have happened if the ACA didn’t put in those caps. I wish the caps would have been lower.

Jim Wednesday, March 4, 2015 at 11:45 pm

You should not eat meat. Vaccines are filled with mercury and God knows what else. Even the flu vaccine is less than five percent effective. They research whether or not Chinese prostitutes perform their duties better drunk or sober. Really helped out down here during Katrina, NOT. Sandy was worse but Obama gets a press pass. They have stolen every dime from the Social Security Trust Fund. Medicare is broke. Medicaid will soon be broke. The Interstate highways are in a total state if neglect. Our blood and treasure has been squandered on ill advised foreign adventures. The 2008 meltdown was directly caused by big government meddling in the mortgage industry. Elizabeth Warren is a major liar and nut case. It’s well meaning idiots like you that have helped us all get snared in the current big government nightmare. Americans are the most generous, caring people in the world without the help of any government stooge. Joan us absolutely correct. Jim

There are plenty of people angry about Obamacare, and I am one of them! Anybody who whines about this horrible bill going down the tubes or “invested in the health care sector are almost certainly driven by one thing: Greed, make a quick buck off Uncle Sam and real tax payers who worked and paid their way all their lives. And, this does not begin to touch base with all the other completely unrelated items or riders that got thrown into this bill. When you have to “pass something before you can know what’s in it”, the red flag should have gone up immediately! This bill should have been aborted before it ever drew the first breath.

Donald Dahler Wednesday, March 4, 2015 at 6:46 pm

I believe the justices should rule against Obama Care. To tax peoples income to pay for health insurance for others should not be legal. Forcing people to get health insurance is wrong and more like what is done in the communist countries. If people have the funds to self insure they should not be required to get health insurance because some politician feels the government and the rich must take care of the poor. There are way too many people on some type of family assistance today. We should be reducing the number of able bodied people on government assistance not increasing them. Those people that have health issues and disabilities, wounded warriors, disabled American veterans and disabled citizens should be allowed government assistance but, the rest need to get a job.

Joe Wednesday, March 4, 2015 at 6:48 pm

Kill Obamacare and replace it with…….nothing! Bring free market reforms to the whole health care industry. Insurance needs to be bought by individuals, just like homeowners, renters and auto insurance. Have high risk pools for those with serious conditions. Privatize the FDA. And have meaningful tort reform. The US health care system will collapse within 10 years if Obamacare isn’t repealed ASAP!

Jim Wednesday, March 4, 2015 at 9:52 pm

Joe! The answer is so simple why can’t everyone see it? If we do as you suggest we will again have the best system in the world in less than five years. And it’s not hard or complicated! Your suggestions have worked on every industry they have ever been applied to.

The Affordable Care Act has been distorted and redone by presidential decision and order, not by law. When it was in the planning stages, the Republicans and all who did not agree with what Pelosi and Reid were doing were shut out of the process, their ideas shoved aside without consideration. There was none of the transparency (coverage on C-Span that Obama promised.) And since the lies about the “protection” have continued and we are aware that the public has been terribly deceived. It is essentially a Democrat law and one without far-sightedness or practicality. Since its passing it has only attracted 10 million persons, not the numbers it needs to support itself. It remains to be seen what happens when employers get further into the situation governing their employees. Another side effect? Insurance premiums have gone way up, not decreased as promised. The whole thing is a charade, a mockery of what a health insurance coverage bill with any common sense should be. My final opinion: it is not a healthcare law; it is an insurance law. Healthcare is something left to the medical profession, not to Congressional panels.

Steve A Wednesday, March 4, 2015 at 7:00 pm

I got bit by a Brown Recluse spider in Florida. I went to a walk in clinic and was charged $1100.00 for them to incise it and clean it. They then told me I needed to go to a hospital and also see a cardiologist. My family medical plan through work costs about $3200,00 per month. I pay $800.00 and the company pays the rest. It has a $12000.00 family deductible.
I was in a panic I knew I was liable for the first $12,000.00 and already laid out $1100.00 plus $200.00 for some kind of antibiotic medication. When I got home I told my wife I was packing a bag and getting on the next plane to Costa Rica. When I got to San Jose I went to CIMA hospital. Nice new hospital. Modern equipment and doctors spoke English. I spent 3 days as an out patient, Had a cardiologist check me out, they ran stress tests, echo cardiograms, blood work and had me on two types of antibiotics and blood pressure pills because the venom from the bite made my blood pressure soar and affected my heart rate,. After 3 days they got the infection and everything under control, got my BP down and gave me some prescriptions for antibiotics and BP meds, and told me I was OK. I went to pay the bill. I went to the office they figured up all the charges for everything I gave them my credit card and the bill came to $376.00. From then on whenever I needed medical care I go to Costa Rica, I like the way they took care of me so much that I sent my daughter down there to have her baby at CIMA. They charged me only $3,000.00 for a C section. I also got an added bonus, a grand daughter that is a duel citizen because they have the same stupid laws as the US where if you are born there you are an automatic citizen. So you all can keep your Obamacare, I want no part of it and I am voting with my feet, when I retire I am moving to Costa Rica The medical care I have experienced there is much nicer and cheaper then what I experienced in the US.

Ian Wednesday, March 4, 2015 at 7:07 pm

I agree with Richard that we have the highest cost system in the world and only mediocre results. However, I do NOT agree with his prescription. Like many pills which deal with symptoms and not the real cause(s), his prescription has too many side effects.
Most govt-run health care systems (like Canada & UK) are overburdened with poor quality of care and lots of waiting. Look up the youtube video on canada’s health care system which was posted about the same time Obamacare was proposed. When patients in the state-run systems are willing to pay something and/or are tired of waiting, they go elsewhere. This “safety valve” is the only reason those systems do not implode
from excess demand and skyrocketing costs. Assuming govt should be involved at all in the health care system (a debatable point as objective experience shows govt frequently runs things poorly because the incentives are not usually in the right places), you should look to the public/private models of many 3rd world countries. The poor go to public clinics, wait a long time to see a doctor, and pay little or nothing. Because the govt in those countries allocates a fixed amount for doctors etc. demand and costs are not allowed to explode (i.e. care is rationed). The middle class and more wealthy go to the private system, which offers little waiting time, and pay more (but by our standards, little or very little). Insurance companies are generally not involved except to negotiate slightly lower prices with private system providers or to cover major medical costs.
Now, if the US went to a system like that with TOTAL TRANSPARENCY on medical providers (to deter fraud) or better yet, went to a true free market in health care (i.e. with only enough regulation to prevent fraud, with no lawyers anywhere in the process, and insurance companies doing only what I mentioned above), I believe we would have better health care at lower (or much lower) cost.
These observations are NOT based on ideology. They are simply based on my own experience of family members in the medical field and my study of what I believe would work best.

Van Atkinson Wednesday, March 4, 2015 at 7:12 pm

Michael Goodman Wednesday, March 4, 2015 at 7:13 pm

Obamacare was ill conceived and should never have been implemented. It was illegally passed in the middle of the night without a single representative having read it. It was illegally voted on and passed without having a public comment period. Any time a politician feels the need to hide in secrecy, they have something to hide. Every congressman and senator who voted for this bill should be thrown out of office and into prison. Each of them have violated their oath of office and lied to the American people. I have no doubt that many of those voting for this bill profited handsomely due to insider trading and kickbacks from insurance companies and other stakeholders.

Millions of Americans who had insurance prior to obamacare no longer have insurance. Those who do have insurance have seen their rates skyrocket and deductibles increase significantly. Insurance should not cost as much or more than rent or a mortgage. If there are problems with our healthcare, then those specific issues need to be addressed individually. Obamcare has made insurance unaffordable for millions of Americans.

Obamacare takes away competition and increases costs for everyone. Taxes have gone up and will continue to rise due to provisions found in obamacare. Those subsidies have to come from somewhere and contrary to what some may believe, the government can only provide subsidies through increased taxation. This bill was passed based upon lies and deception. The supreme court should do the right thing and throw the bill out.

Vince Wednesday, March 4, 2015 at 7:21 pm

. The crux of the matter has have nothing to do with Obamacare at all. It has more to do with the behavior of the Supreme Court. Justice Ginsburg has offered that not allowing subsidies in states that have federal insurance exchanges was obviously an oversight, i.e. she would undo the wording of the law to correct her perception of an error. Well this again would be a reprehensible act of the Supreme Court writing (or editing) law in the guise of interpreting the law as written. Justice Roberts in a previous ruling on Obamacare changed the meaning of the penalty for noncompliance to a tax, which therefore made it OK, contrary to the administration previously insisting that it was not a tax. Obamacare saved by judicial fiat. Further, that the law allows for subsidies is once again the act of the progressive left thrusting a socialistic element down our throats. Never forget that the majority of the population does not approve of Obama care. It’s my considered opinion that the Supreme Court is the most flawed of branch of our government. It is inconceivable that nine individuals can control the course of an entire country, via their opinions, and opinions are after all subjective and will change depending on the judges on the bench at any particular time. The judges aren’t responsible to the people, who were suppose to be constitutionally sovereign, but are generally selected with political bias in mind with an ambiguous approval by the Senate. Ambiguous because there is always the element of compromise and exchange of political quid pro quo.

John Russo Wednesday, March 4, 2015 at 7:21 pm

Health care is not affordable. Subsidized insurance funded by taxpayers does not correct overpriced medical cost. there is no control over drug prices and hospital costs.

My recent unexpected trip to ER at a local hospital, Desert Regional in Southern California came with sticker shock. The ER room to walk in was $5,322.64, Really!!
Pharmacy for an inexpensive medication in solution was $879.82.
Supplies $281.32 No movies, popcorn or drinks were given.
In about three hours a non treatable condition which should not have been treated cost me for the hospital $6483.78 The ambulance company, AMR, demanded $1,769.17
This is one reason INSURANCE PREMIUMS ARE NOT AFFORDABLE . THIS IS NOT AFFORDABLE HEALTH CARE. This is proof that the President, Congress or the Senate does not run this country but merely profit from it. Is anyone ready to fight and end this atrocity? They do this because they can and you have to pay it because they can make you pay it.

Tom H Wednesday, March 4, 2015 at 7:23 pm

All we hear about on the liberal news is the whining from people who get subsidized health care from obamacare and are fearful of losing it. No mention is made about the millions of previously insured people who saw their health care premiums substantially increased due to the socialism called obamacare. Also, there is no mention of the number of doctors and other healthcare professionals who plan to exit the profession because they receive insufficient compensation from obamacare. My cardiologist is one of them. Last, but not least, how many current students will decide or have decided to seek another line of work. This will lead to insufficient doctors and health care rationing.

Jim thorpe Surfer Wednesday, March 4, 2015 at 7:25 pm

If as you imply its a questionable LEGAL argument, why in the devil is it being argued in front of the Supreme Court? lol

Cacurmugeon Wednesday, March 4, 2015 at 7:30 pm

Our entire healthcare system is a mess. The Affordable Healthcare bill was written by a bunch of Congressional hacks and a wet noodle backboned Obama, tutored by lobbyists, all of whom are more interested in the money they receive from the health industry than the other 90% of us, while themselves enjoying gold plated healthcare that they determine and obtain at taxpayer expense. Now even that flawed law will probably be jettisoned by a Neanderthal SCOTUS. Of course, they receive gold plated coverage at taxpayer expense too. Why does anyone think that this totally political money grubbing group has any concern for the problems of the ordinary citizen. The rest of the civilized world all have government health programs, but not the exceptional and modern US.

Jon Parkinson Wednesday, March 4, 2015 at 7:38 pm

Supreme Court should have better things to do than listen to the Obama hater crowd. This case is clearly nonsense. I am certain that all Supreme Court justices will all go with Obama on this except for Justice Thomas who never contributes to legal arguments. I think the court is 4-4 on most good cases with Thomas just voting Republican.

Jim Wednesday, March 4, 2015 at 10:01 pm

I confess. I Really do hate Obama and everything he stands for.

George Wednesday, March 4, 2015 at 7:38 pm

Instead of all the complex Obamacare provisions which invite disagreement and endless wrangling what was needed was 1. law that said insurance companies should not refuse coverage because of pre-exiting conditions and 2. a law governing medical insurance rate caps for different classes of people depending on their health conditions so that few would be priced out of the market altogether and so that the medical insurance premium costs would be more fairly spread across the people in different health condition groups. Thus healthy people who don’t use many medical services would have low rates and people who use lots of services would pay higher rates but still be able to get and afford medical insurance. And those who chose not to insure themselves at all would have that right and risk.

jeff Wednesday, March 4, 2015 at 7:42 pm

Why do we seem to always leave the big decisions to nine people?

Howard Wednesday, March 4, 2015 at 8:13 pm

Because a stupid government bureaucracy of hundreds stuffed it up in the first place.

Joseph Ahlert Wednesday, March 4, 2015 at 7:51 pm

This is not a questionable legal argument. It is black and white, clear cut, etc. The law clearly states that this is a State by State issue and the Federal government has no legal right to provide subsides. This was written into law 5 years ago and now that the administration doesn’t like the results they opted to break their own law. It is now up to Congress you the LEGILATIVE BRANCH to fix a flawed law.

ricecake Wednesday, March 4, 2015 at 7:52 pm

Tell you what, U.S’s so called Healthcare was unaffordable before Obama Care. Obama Care have made it even more unaffordable. Before Obama Care, the deductible was not as large and the individual co- pay was smaller %. Now with Obama Care, a healthy lower middle income person pay about $130/monthly with a deductible of $6600. After fulfilling the deductible, the individual’s co-pay is 40%. So what kind of deal is that? Not only the plan is much more unaffordable, you are fined if you don’t buy into the scam. At least before Obama Care, you have the rights to not to buy insurance and not be fined.

However, for the poor, such as making less than $15000 annually, they pay zero premium and enjoy almost free healthcare. But for many of those who make more than that are now unable to afford to buy the plan and be fined for not buying the unaffordable plan. And for those who are buying the plan, getting much less from it.

Moreover, the providers can up prices as they wish the government forget to or have not set a max cap on prices hike. When the government tax or force people to buy those products the government must regulate the prices and cost and stop it the hike when needed.

Jim Wednesday, March 4, 2015 at 8:04 pm

Gosh, maybe a record response and virtually all of you have it wrong. Their are two primary villains in our healthcare mess. The Pharmaceutical Industry has taken over our medical schools and now teach our Doctors that surgery and chemical deficits are the only approaches allowed. They don’t cure us, the treat us, indefinitely. Repeat customers mean big profits. You will rarely hear a healthcare professional talk about correcting the CAUSE of your illness or even trying to determine it. How many of you have been on some kind if medication for ten years or more or take five to ten different scripts. Because I am one I can assure the real reason our healthcare costs much more than Europe is because we have several times the TRIAL LAWYERS. Massive costs are imposed on our system by these parasites because our Tort Law does not have the “loser pays” feature. Every nuisance lawsuit must be taken seriously and costs us all an incredible amount of money. Congress never do anything about this because they are all LAWYERS!!! Jim

Prescription drugs are the third leading cause of death in America. Our real healthcare crisis is lifestyle issues like smoking, obesity, poor nutrition, additives. These are all choices and we all make lots of bad ones and think someone else ought to have to pay to fix us. Bullshit! Eat right and get some exercise and watch those healthcare bills plummet. I damn near died of a heart attack at 48. I cut the crap, stay active, and feel better at 65 than I did at 35. Jim

Bruce S Wednesday, March 4, 2015 at 8:16 pm

Let’s keep focused on this tiny little technicality that is the entire basis of the current SCOTUS case. At issue is whether or not people are eligible for the subsidy. The deciding factor, according to the plaintifs, is whether the insurance was purchased at a state website or a federal one. IF the net effect is who would pay the subsidy, (the state or the feds), then the case could have some merit. But the feds are paying any and all subsidies. The INTENT of the law is perfectly clear to anyone who understands the English language. Everyone should have insurance, for the clear good of the many, and at the risk of some detriment to a few. Those who can’t afford it should be eligible for the subsidy, (regardless of where they purchased it). So the current argument is over a stupid pointless semantic technicality. John Boner and his teabagger cronies won’t admit they lost the battle and the American people got what the majority of them wanted with the ACA. Same stupidity as all the southerners who still won’t come to grips with the reality that the south lost the civil war.

Frank Ellis Wednesday, March 4, 2015 at 10:43 pm

Bruce, please look at the actual wording. It clearly says that subsidies will be paid to the states that set up their own exchanges. This is very clear, and Gruber confirmed on tape, that it was meant as a bribe to induce the states to set up their own exchanges. The war between the states really has nothing to do with this. Not a good analogy at all. Even us slow, hill-billy rubes from south of the Mason-Dixon line can read this well. By the way, polls have consistently shown that a majority of Americans want Obamacare repealed. Check it out.

Jim Thursday, March 5, 2015 at 12:06 am

The ACA has never enjoyed majority support of the public, and never will. That’s an undeniable fact. If we don’t get rid of it it will collapse under its own weight. It is a poorly written, poorly reasoned, poorly conceived bill that is doomed one way or another. If it does “succeed” it will bankrupt America. You are right about the outcome of the case though. As a stupid Southerner I know we lost the war because our cause was ill conceived and poorly executed. The ACA will lose for the same reasons. I know a loser when I see one. Jim

This is what happens when you pass a bill without reading it and debating on the flawed portions within the bill in the middle of the night. I can’t feel sorry for the arrogance of the Democrats that rushed this through and applaud all of the Republican Congressmen that voted against this badly written bill done by the insurance company lobbyists. So who is really looking after the little guy? After all that is done, there still will be between 20 to 30 million people that still won’t have healthcare. So what did this achieve? Answer – It achieved the raising of premiums for the medical insurance companies.

I’m a conservative, and did whatever I could to fight Obamacare before its inception, with e-mails, phone calls, signing petitions, etc. I live in Colorado, have a democrat governor, so naturally he bought into the whole program, and set up an exchange in accordance with the new law. As luck would have it, I have found myself unemployed for the last several months, and am now on OBAMACARE! Argh! I certainly don’t feel right or good about having subsidized healthcare, but felt it was important to have something, rather than nothing. But, without a job, and with how the health insurance rates have skyrocketed due to the new law, I’ve pretty much been forced into accepting this horrible conundrum that I’m in. But, even though I’m presently a beneficiary of the law, I’m still in favor of repealing Obamacare completely, and I have no intention of remaining unemployed, and in the program. No good can come from the government having control over your healthcare. As President Reagan said, if the government has control over it, they have complete control over you. So, if I take a big hit from the Supreme Court decision, so be it. I’m prepared to deal with it.

Mike: Obama care must be repealed in full. We must go to a true free market system, where every working American will have a health care savings account, pre tax. The amount allowed is to be determined. Under this suggestion, the employer will play a passive role instead of a active role. The employer will make a quarterly contribution to each employees health care account. the amount should be between employer and employee. By owning your own health care policy an employee will be freer to leave a ob that he or she has outgrown. Throughout our respective lifetimes, we the people have crossed state lines to buy our own homeowners policies, our auto policy and other policies. Health care should be no different. We must encourage people to be more self reliant and less dependent on government. This proposal would to that. In order to make this proposal affordable, we must crack down on insurance fraud and reform the tort system. In 2008, we spent 200 billion dollars suing each other. We are the most litigious society in the world! This cannot continue if we expect to compete in the market place. Regards as always, Robert Calabro.

Run for Congress. Please!

Clinton Chamberlain Wednesday, March 4, 2015 at 10:10 pm

I got through the first 1,000 pages of the Obama Care bill and gave up at that point. I’ve had the misfortune to have read many state and government laws and this thing was the most weirdly put together, with no apparent attention even to the basic rules of grammar, to say nothing of attention to basic sentence structure that I’ve ever encountered. About the only that a reasonable person could conclude l is that the law was written by fools who were out to grab huge monies from the rubes. I believe it would take a fool, or a totality uneducated individual to wade through the mess without showing acute signs of gastric unease.

So I conclude from the size and the ambiguities and the utter nonsense of so much of the bill that the whole thing is just obscene. I can only suggest as least some members of congress or the Supreme Court, whether republican or democrat, make the effort to try to even read the first few pages of the the monstrous pile of garbage, something which they obviously have not done. I can only hope that the Supreme Court people will try to read he thing for themselves rather that pass the chore on to some poor new lawyer type.on their staff.

Donald F. Mackay Wednesday, March 4, 2015 at 10:14 pm

The health care insurance companies were around long before Obamacare, and will be around long after Obamacare is a footnote in the history of government folly.

These same health insurance companies are infinitely smarter and more experienced than the grossly overpaid, egg head theoreticians that Obama foolishly counted upon to create his signature healthcare plan.

The private health care companies have gone along with the Obamacare gag because it was the law, and because it was highly profitable. However, doubt not that each company has a plan B ready to go when Obamacare implodes upon its own inequity, over complexity and fallacious economic basis.

How about those persons with chronic conditions that will again be unable to obtain health care insurance? The answer could be that these persons would be covered, at cost, in a health care insurance “pool” with each health care insurance company participating pro rata in the “pool” in accordance with its share of the overall private health care insurance market.

Frank Ellis Wednesday, March 4, 2015 at 10:27 pm

The Court should (ha-ha) rule on the wording in the law. The law was written expressly so that only the states that created their own “exchanges” would receive the subsidies. This was made even more clear by Gruber, the main author of the law. This wording was intended to “bribe” the states into setting up the state run exchanges. I’ve seen him on tape explicitly saying this. This case will go a long way in seeing if we are still, at least partly, “a Nation of laws and not men.” Obama is doing his very best to completely destroy that concept. He has “a pen and a phone.” The Congress, to him, is little better than chicken crap. It is a terrible law, and for much less money and confusion health insurance can be made available to those that need and want it.

Brigg Lewis Wednesday, March 4, 2015 at 10:34 pm

B. Lewis,
We have a major problem with Obamacare as it is all about insurance coverage for all people. What we should be focusing on is the medical needs of people. Insurance coverage simply places a for profit company between people and their doctors. It inserts an unnecessary layer of bureaucratic costs that only serve to drive up the cost of health care. Free health clinics inpoor area staffed by government paid doctors would provide similar care at a much reduced cost to the tax payer.

Most of us only need catastrophic insurance to provide a safety net for serious accidents and major health issues, not day to day care.

Glenn Younkin Wednesday, March 4, 2015 at 11:22 pm

We need free markets not central planning one size fits all. We need respect for the
constitution and follow the law. We need people to know what it means to take an oath
and mature enough to live up to it. This only benefits health insurance companies and
not the medical needs of the people. Do you remember when Obama said perhaps
you don’t need that expensive medical procedure when a less costly pain medicine will do.
The majority of politicians are not doctors, so why would any sane person take medical
from a politician? These are snake oil salesmen, not people that have your best interest at heart. Wake up and smell the coffee and then drink it. That will benefit you better than Obama Care ever will..

jim Thursday, March 5, 2015 at 12:04 am

Obama care just shifts burdens. And the middle class cannot handle anymore. If the government wants to help the poor — do it. Add the burden to EVERYBODY. My health care plan went to crap as my employer passed on the cost.

My “poor” friends are having “procedures” and laughing at me as I continue to work. DOH!

Obamacare is NOT insurance.Insurance is priced on risk to the insurer.Obamacare is a welfare program, where price is based on your income. As long as there are no enforceable penalties for not buying,I’m out.Give me massive subsidies and I will reconsider.

Dhimmitude

The word “Dhimmitude” is found in the new health care bill; so what does it mean?

Thought this was interesting and worth passing on.

Obama used it in the health care bill.
Now isn’t this interesting?
It is also included in the health care law.

Dhimmitude — I had never heard the word until now. I typed it into Google and started reading. Pretty interesting. It’s on page 107 of the healthcare bill. I looked this up
on Google and yep, it exists. It is a REAL word.

Dhimmitude is the Muslim system of controlling non-Muslim populations conquered through jihad (Holy War). Specifically, it is the TAXING
of non-Muslims in exchange for tolerating their presence AND as a coercive means of converting conquered remnants to Islam.

Obamacare allows the establishment of Dhimmitude and Sharia Muslim diktat in the United States .

Muslims are specifically exempted from the government
mandate to purchase insurance, and also from the penalty
tax for being uninsured. Islam considers insurance to be
“gambling”, “risk-taking”, and “usury” and is thus banned.
Muslims are specifically granted exemption based on
this.

How convenient. So I, as a Christian, will have crippling IRS liens placed against all of my assets, including real estate, cattle, and even accounts receivable,
and will face hard prison time because I refuse to buy insurance or pay the penalty tax.

Meanwhile, Louis Farrakhan (the Muslim) will have no such penalty and will have 100% of his health insurance needs paid for by the de facto government insurance.
Non-Muslims will be paying a tax to subsidize Muslims. This is Dhimmitude.

All American citizens need to know about this !!

snopes.com:
Health Insurance Exemptions

is the Muslim system of controlling non-muslim populations
… The Obamacare bill is the establishment of Dhimmitude
and Sharia …

Keep this going. Every non-Muslim in the United States of America needs to know about this.

Obamacare is fundamentally flawed and should be repealed entirely. It is a power grab by an overreaching government that ignores inconvenient laws and Constitutional restrictions. This ACA must be replaced with a more rational, less obtrusive and simpler law.

Adrian Shiner Thursday, March 5, 2015 at 5:47 am

Your government and judicial systems are fundamentally corrupted. I quite expect the court to effectively kill Obamacare. That will not serve the best interests of the population of the USA at all. Access to healthcare, irrespective of your assets and income is arguably a right as important as the right to justice and free speech. Looking at the USA from the UK, I am amazed how people are so stupid to vote for political parties who act against those peoples’ best interests. Without naming names, as an example, Kentucky is ill served…..

There are no free funding ‘rights’. They are a gift from a compassionate society and from the more well off to those less fortunate. Socialism has not worked around the world very well. Currencies are being destroyed and tensions are built because some feel that they have a right to bludge on the taxpaying dollars of other workers.

I do not believe this case has merit and believe the Court’s decision will, in large part, hinge on its interpretation of the term “state”. Will the Court interpret “state” strictly in the context of a “state” government (i.e., Ohio as part of the 50 states comprising the Union)? Or will the Court interpret “state” as a legally constituted government? I believe the latter should pertain. This is supported by the fact that, in DoD parlance, we refer to state (i.e., a country: Great Britain) and non-state (i.e., Al Qaeda) actors in the international community. If the Court holds to that interpretation, then the Federal Government constitutes a “state”, and the Court will rule that subsidies can be provided by either a state government or by the Federal Government.

Yours is a case for poor government and sloppy policy. Good policy has merit

What wrankles most about Obamacare is that the law was written by Democrats only – there were no Independents, Libertarians, Republicans or even Vegetarians in that room – so it is a Democratic law that had neither debate nor outside input. No wonder it is a disaster!

David Ecklein Thursday, March 5, 2015 at 8:41 am

ACA (ObamaCare) is the most expensive healthcare reform in world history. So much for being “affordable”. Yet it will not solve our national healthcare problem. The expansion of insurance coverage does not mean the expansion of actual care. The lower tier policies supposedly intended to protect those who could not afford insurance without government subsidy have large deductibles and copays which will still threaten impoverishment and bankruptcy. Meanwhile, the insurance industry has a captive market, with legally enforced sales, and a guarantee of profit via ACA government subsidies. Furthermore, with healthcare coverage depending on insurance company rulings rather than medical needs, there will be effective denial of care as it is now. We need to remove insurance from the loop and abandon attempts to prop up ACA. We already have a popular and relatively efficient system now, Medicare. We need to expand and improve this system to cover all ages and conditions. Of course, it will cost more than current Medicare, but much less than the insurance premiums under ACA,

We have a unique health care system in the US – the most costly per capita in the world, and with health outcomes below that of almost all other modern nations. But we have excellent hospitals, doctors, and research facilities. Why can’t we do better than ACA?

The Obama Democrats seem to have no contingency plan should the ACA be overturned. They are more willing to blame the resulting train wreck on the Republicans than consider a more rational alternative – improving and expanding the Medicare system already in place and tested for years to be watertight both legally and financially.

Jim Bandinelli Thursday, March 5, 2015 at 8:53 am

What is a subsidy? Financial assistance given by one person or government to another. In other words tax money extorted by our government from working Americans to give to those who do not or will not work. Unfortunately, and all too often, those receiving the ‘subsidy’ are healthy Serfs who don’t want to work, have no intentions of working, and are and have been wards of the government for generations! That is why nearly 100% of Working Americans know that they have been given the shaft by the socialist liberal democratic party, which unfortunately ruled the roost when this POS socialist system was enacted. Now we have all been taught that Socialism is good until you run out of other people’s money, thank you Margaret Thatcher! And our government ran out of money a long-long time ago and now owns 18.5 Trillion dollars in debt, 100 Trillion in short and long term obligation! Socialism and Socialist systems like Obamacare are a FAILURE! Liberalism does not equate to Liberty, Freedom, and the Pursuit of Happiness, Write It Down!

Yes this is a rhetorical question but how is it that many of the people that could afford the Obamacare are exempt from it? More of the same? Got position not equality, fairness or respect then you get special rights that others are denied? It almost sounds like slavery to me. I’m being forced against my will to take care of others when I have spent a lot of my money on my health and many of them didn’t. They chose potato chips, I chose vegetable and now I must pay?

Lovell Thursday, March 5, 2015 at 10:37 am

I would like to be rid of Obamacare. I pay 100% of my insurance costs and they have risen dramatically since Obamcare was instituted. Doctors are retiring early to avoid the paperwork hassle that has been imposed.

RJ Thursday, March 5, 2015 at 10:55 am

Justice kennedy’s statements are VERY concerning! He’s basically anointed Obamacare a Too Big To Fail type program. If challenging four words would undermine the entire system, then i can’t imagine any challenge to this flawed system getting a fair trial.

Jim Thursday, March 5, 2015 at 10:55 am

I was born in 1950. My mother spent two weeks in the hospital. The bill was $125 and my parents were given six months to pay it. No insurance! My last child cost $15,000 and my wife got two days in the hospital. The two big differences between then and now are third party payer and big government involvement in healthcare. Everyone in America could have affordable first class healthcare if we the people took charge and demanded it of our leaders. We would not have to pit one group against another. We leave these decisions to lobbyists and government hacks and we get exactly what we deserve. Jim

THE MAGICIANS

I am not so sure that the outcome of the pending Supreme Court Case concerning ObamaCare premium subsidizes will be that consequential, either way. It may not turn out to be the deal breaker for ACA. Here is why:

There are many possible ways to keep ObamaCare on-track when you are working with a rigged system. That’s all Government and Central Banking is anymore, a rigged-system. Magicians know how to use illusion to create “magic”. Politicians, Judges, and Presidents today are “magicians”. Watch them do their magic in June.

Mike…….Been involved in the Benefits business at Cigna and as an Insurance broker for 60 years and we’re ready to hang up our shield. Businesses have sponsored programs for about 80years in the effort to recruit and keep the best quality employees. Meanwhile, our country has been blessed with the best medicine in the world. It’s difficult to say how you ‘d describe the Affordable Care Act, which starts as an effort to protect some 40 million uninsured….including immigrants..

Maybe it’s like a quasi utility approach….which might work ….EXCEPT. How would you trust and attempt to comprehend any legislation where; (1) Gruber (MIT prof) brags about “gaming” the COB (2) Pelosi confirms ‘we have to pass it to know what’s in it” (3) Harry Reid relies on lobbyists and other self interested parties (4) the President with his name on it never legislated a nickels worth in Illinois and maybe just an ear mark on someone else’s bill in the US Senate. (You can check it out….$1million to UC Hospital ….for a very special reason…..his wife had a part time job there)

Badly crafted legislation is just that…….and now…”Here comes the Judge”

D Bush Thursday, March 5, 2015 at 2:37 pm

Mike, as a former licensed health insurance agent in the state of Texas, all insurance must be purchased from STATE regulated insurance companies. Insurance is regulated by each state’s regulatory government agency/organization … and not by the federal government. State insurance agencies monitors premium pricing and all agents, brokers, companies, consumer service/ complaints, financial solvency, fraud and other issues for each company for each of the different insurance products that each insurance company sells (including homeowners, commercial, automobile and other vehicular insurance and all other forms of domestic insurance. Thus, the Affordable Healthcare Act clearly defines that the health insurance is purchased through the market place established by the STATE … and not by the federal government.

Thirty-seven (37) states elected to not set up “state exchanges” for implementing the ACA (Obamacare) largely because of the burden to each states of … expanding the rolls of Medicaid (that would increase exponentially and where all costs would ultimately rest with each state after a few years of implementation). And because the states were not represented by their Congressmen (where their Republican representatives were excluded from all input into the drafted legislation) and not one of each State’s Republican Congressman voted for the ACA legislation. And because the ACA bill was hurriedly rammed through by the Democratically controlled Congress and signed by the president … so everyone could READ IT later. Oops. forgot the part about the exchanges being set up by the (each) STATE.. Do not forget about the elimination of all the full-time jobs since 2010 … some replaced by “part-time” jobs … to avoid the TAX (penalty) that everyone is now worried about.

This lawsuit is about legal and fair principals. The consequences of those who bought healthcare stocks is not the concern of principled American citizens. It is not about hate for the president. It is all about lack of representation for all citizens by their elected officials, back-room deals, and a liberal government with no regard for the real impact on our legal system and on the well being of our nation. Honor is not a value that our elected representatives truly hold dear. In these tumultuous times, power, domination, personal enrichment and self aggrandizement are regretfully the traits of most of our elected leaders and representatives. -D Bush, 05-March-2015
Mike’s questions: “With this major challenge underway, I wanted to hear your opinion on Obamacare. Does this case have merit, and would you like to see the law derailed? Or is it just another attempt by disgruntled Obamacare fighters to stick it to the President with a questionable legal argument? Are you invested in health care stocks, and worried about the outcome here? Please share your thoughts at the Money and Markets website when you have a minute.”

KAREN Friday, March 6, 2015 at 12:50 pm

D Bush, I’d like to thank you for taking the time to explain some of the very obvious reasons this entire law needs to be scrapped! I don’t know of any explanation which I have read so far that covers the flaws any better then your does!

Joseph Wooldridge Thursday, March 5, 2015 at 2:48 pm

Making people buy insurance does nothing to slow down the rapidly rising costs of medical care. And yet the Republican approach of free markets will not work in this case either because medical care functions mostly as a monopoly. No one really understands what they are buying or how much it costs or even if an alternative provider is available when it comes to medical issues. And under the current Affordable Care Act, insurance is going up even faster. Many families are seeing monthly insurance bills that cost as much or more than what a mortgage payment used to be. Subsidies for the monthly payment will be fought over in the courts for years. The Federal government will, in effect, be enacting an asset tax, when they implement the means testing for the subsidies. In the end it will probably all be “fixed” by just having everyone be covered by medicare. Social security will be diverted. A dramatic rise in deficits will be the normal course of business. It’s all ugly. And as Americans our voting choices amount to going with the Republicans who will offer no solution, or going with the Democrats who will offer a really stupid “solution”.

Marilyn Thompson Thursday, March 5, 2015 at 3:13 pm

I worked in healthcare for 13 years, then teaching, now not able to work due to illnesses. It would be devastating to all the millions of people with Obamacare Health insurance through the Marketplace. Without the subsidies, my husband, myself, and my daughter would be without health insurance. This is big for self employed middle-low class families like mine. I have medical issues and my husband recently had a rotator cuff/tendon repair due to 25 years of manually building. We pay our taxes and can’t get any other benefits from the State. A lot of people don’t like the fact that we have the subsidies but at least hospitals aren’t getting flooded with patients who can’t afford to pay their healthcare bills.
It is the step in the right direction. Universal healthcare ( like Canada) isn’t the option either because a person would go months without getting needed surgery or medical procedures. I believe this is a battle from the Republicans and Democrats and the lack of support for our President. I think people will complain ” just because”. He got us out of the bank situation back in 2008-09 , when we almost lost our home, like others. He has tried to help College students with college debt. This is just a step in the right direction to get health benefits for everyone. The hardest part is with this, the IRS is involved, and this is the first year with subsidies and it is a nightmare for accountants. I just wish our Congress and House would answer problems instead of creating more!!

KAREN Friday, March 6, 2015 at 12:39 pm

Marilyn it’s great that you have this coverage, but it actually is at others expense, (we are self employed also and frankly we are living off savings right now, so my family is like your family). It is not fair that people are required to have and pay for coverage that is completely unnecessary to them(for instance, a male being required to not only have, but pay for coverage in the event of pregnancy! Last time I checked, men do not get pregnant!) It’s the governments way of forcing them to contribute so others can have their coverage. Hospitals have been and will always be flooded with people who can’t pay their bills and that’s because healthcare costs, in general, are so totally over inflated. Why, because first and foremost a hospital is a business with a bottom line, plain and simple! The IRS, a department of the government has absolutely no right to be handling people’s personal medical information, however they have been given this right though this law. A law that I will remind you, no one has even read, so heaven only knows what else is in there that we haven’t been hit with yet. I personally know several people who are waiting for decisions to be made on their care so this might as well be Universal Healthcare with a different label on it. On the bank bailout, the president didn’t get us out of that, we tax payers did! You may be right, this could be a step in the right direction for health benefits for all, except that this law itself is so very flawed, it will not be productive in it’s current format. A president does not posses the authority to sign a law into effect and then to re-write parts of it to suit his whims, doesn’t matter it he’s a Democrat or a Republican!

tbrit Thursday, March 5, 2015 at 4:10 pm

ObummerCare needs to be completely scrapped.
ObummerCare is a tax that should never have been placed on We the People. The majority of Americans did not ask nor did not want this “service.” The govmint sold us down the river as did roberts of the SC.

A much less costly (how much did that software cost again? Billions? Geez!) methodology would be to get folks with no income on Medicaid, get folks with a bit of money on Medicare, and let the rest of the American herd with jobs (and coverage) co-fund their own insurance through their employers.

What’s so difficult about this?

David Rogers Thursday, March 5, 2015 at 4:52 pm

The A.C.A. offers a wonderful and needed service for millions of our citizens whom without it would not have this very needed service. Those of us that could well afford health care ins. have been subsidizing these costs. I am hoping that the courts do not overturn this health care for the poor.

Jim vadnais Thursday, March 5, 2015 at 5:00 pm

Obama care is an abomination which needs to be scrapped entirely it is not free, the hardworking people flip the bill yet again. Medicall service is deteriating, as witnessed myself and talking to people in the medical field. all costs and taxes have not yet kicked in. I have spoken to people that no longer were able to keep their previous medical plan. This is much more of a financial drain on the working class than free Obama phones. Plus, this was pushed through even though no one read the 100’s of pages entailed with this plan and the majority of the population was against it.

Maughan Thursday, March 5, 2015 at 7:10 pm

This Supreme Court is so political, it matters little the arguments presented. At least 7 had already made up their minds before Wednesday. Four will support Obama whatever he does; 3 will support the Constitution. The other 2 are likely to split, with Roberts again going with the “Progressives”. And thus the Constitution is still further weakened.

Ed Stahl Thursday, March 5, 2015 at 11:11 pm

My only question is “what constitution? Seems that and something referred to “The bill of rights” has disappeared too! Those clowns are the opposite of “Ivory soap” (99% impure!)
The bad news is that I lived close to 75 years in a free country– but expect to die in a dictatorship!! … Good news– I don’t have to pack and move away from freedom! Unfortunately we are now a “one party system”,– though some have a different (party) name behind their names!

KAREN Friday, March 6, 2015 at 12:08 pm

Obomacare is nothing more then a nightmare and it needs to be outed! No one even read the thing before they made it a law and that, to me, is unacceptable, The government has no right forcing any of us to purchase something we don’t want. The president doesn’t get to make changes to a law just because it suits him. That one thing alone should shut this law down completely!

John Friday, March 6, 2015 at 4:02 pm

Obamacare is immoral, birth control and abortion required coverage, and takes away the right previously given by laws to individuals and privately owned small businesses to practice their faith. As far as I know, there is no provision in the constitution to allow the federal government to pass such a law. The constitution only gives the states the right to pass such laws. I hope the court rules that the subsidies for those who bought on the federal market are illegal and that this program will be shut down.

Gary Saturday, March 7, 2015 at 8:14 am

The law clearly states exchanges established the states. If the court rules that way then
I think congress will be forced to revisit the healthcare problem and maybe come up with a
workable solution. The only way to reduce healthcare costs down is to get group third payers out of the business including the government.

earl Saturday, March 7, 2015 at 9:15 am

Given the unethical bent of the Congress and the Insurance Industry paying them off, with the hope of ever increasing premiums, to be paid for by those who do pay taxes, it is my hope that the third branch of government is not so corrupt that they find these subsidies illegal.

Chuck Stone Saturday, March 7, 2015 at 10:58 am

Pathetic that opponents of the Affordable Care Act (ACA) ranted and raved on the myth of “Death Panels.” Now those same opponents are attempting to use one four word clause, despite numerous other clauses which clearly contradict opponent arguments, to destroy subsidies for 6.5 million Americans and sentence them to death. At least now we know who is in favor of “Death Panels.”

steve Saturday, March 7, 2015 at 3:40 pm

Even THE ECONOMIST (not known for liberal views) opined that SCOTUS should leave the law alone.

Gary Saturday, March 7, 2015 at 11:06 pm

Obamacare is flawed in so many ways that I am favor of anything that helps dismantle it. One of the arguments used by its supporters was that our health system was “broken” and needed to be fixed. Our present government is broken to a far greater degree, and neither of our two parties have any comparable interest in fixing it. Few pundits are willing to voice the simple fact that this huge power grab was intended to accomplish one primary goal: take our tax dollars to redistribute to those who vote for the present administration. In any other country this, and many other similar actions by Obama, would qualify as graft and corruption.

Johnny Monday, March 9, 2015 at 2:41 pm

Obamacare appears to be poorly written which is no surprise considering the rush to get it implemented and lack of bipartisan support. Now that it is law the Republicans should spend more time fixing then trying to dismantle it. They need to offer alternatives to the parts they either don’t like or need fixing, write the appropriate legislation, pass it then bring to the President to sign or veto. The Republicans need to realize that they probably won’t dismantle Obamacare and doing so now would create major ripples in the economy and make the look like fools once again. Fix it!

Obama care is a horrible law in every aspect. First of all, nothing in life is free. If any one is getting cheap or affordable healthcare, then the tax payers are paying for it which will result in higher and more taxes that tax payers can not afford.
Secondly, every ones health care has gone up 30% or more and are getting less coverage as a result of Obamacare and these are facts! Some people had to drop there care and others were dropped by their insurance companies. I spoke with people who got their health care for free and some who got it very cheap, like I said nothing is free, this means that taxpayers are paying the difference somehow. Others have gotten ridiculously high premiums for only making 20,000 to 30,000 per year. Maybe they are paying for the cheap and free policies!!
Thirdly, many businesses are suffering if not going out of business as a result of the new laws for them. This means loss of jobs and more possible welfare recipients and more free health care. This is also a very hard hit for an already ill economy.
I agree that we need to do something with our healthcare system. If you want to have an affordable health care system, then let’s do so. You can start by ending ridiculous lawsuits, and making medicines more affordable. When I go to another country I can get insulin for almost half the cost of America. If I need health care while I am there I have to pay for it because I am not a citizen, what a novel idea!!! If I go to another country illegally I will be jailed, shot in some, and if I am lucky I will be deported. What a great idea!!
Lastly, If this healthcare system is so good why does the government not have to comply with it? Our government is not to impose anything on the people that does not pertain to them!!

I have a stake in Quadrant 4 [ticker QFOR] http://www.qfor.com
It is a private marketplace in the healthcare field. Will this company be influenced by all this possible changes or will it benefit?
All your thoughts are welcome.
